David J. Thibodeau, Jr.
David’s practice emphasizes the building and refining of patent portfolios, strategic advice concerning competitive IP rights, and due diligence for technology-based financial, merger/acquisition and other business transactions. David most often handles prosecution matters before the U.S. Patent and Trademark Office and foreign patent offices, but he has also successfully concluded litigations and other disputed matters.
He has specific technical expertise with mobile communications, data storage, database systems, web applications, signal processing, network security, circuits, semiconductors, precision optics, and audio systems. These include both hardware and software implementations.
David has helped numerous technology companies realize value from their patent portfolios, assisting with high-value corporate liquidity events, follow on private investments, and licensing-out transactions.
Prior to law school, David was an engineer with IBM and then Sanders Associates (now BAE Systems), responsible for hardware and software design of national security systems and graphic displays.
David also served as Vice President and General Counsel for AirNet Communications, a venture funded company in the wireless industry for several years.
He is past President of the Boston Patent Law Association (2000-2001) and currently active as the BPLA's delegate to the US Bar - Japanese Patent Office (JPO) Liaison Council. David is a member of the Hon. Arthur J. Gajarsa American Inn of Court, the American Intellectual Property Law Association, the Institute of Electrical and Electronics Engineers (IEEE), and a licensed amateur radio operator.
David served for many years as an Adjunct Professor of Patent Law at Franklin Pierce Law Center (now the UNH School of Law) and has been an invited guest lecturer before bar associations around the country.
- Successful defense of several litigation matters, resulting in low or no-cost settlements prior to trial for clients accused of patent infringement.
- Developed many patent portfolios leading to significant license revenue and/or client acquisitions in the wireless communications, cable television, semiconductor, and flat-screen display industries.
- Assisted with a billion dollar initial pubic offering of a Massachusetts database technology company.
- IP counsel for a New Hampshire information technology start up during their billion dollar private acquisition event.
David has also been selected by his peers three consecutive years for inclusion in the 2015, 2016 and 2017 editions of Best Lawyers In America for the practice area of Patent Law.
